EULA - End User License Agreement

"CrosswordJet" End User License Agreement (EULA)

DEFINITIONS:

- SOFTWARE PRODUCT here means software, installation files, database files, all other accompanying files received with your download of "CrosswordJet" and SOFTWARE OUTPUTs.

- SOFTWARE OUTPUT here means data (crossword) produced by the "CrosswordJet" software as a result of using "CrosswordJet" software. The data is in the form of electronic files, screenshots and/or manual transcriptions into any other form.

- AUTHOR of the SOFTWARE PRODUCT is Mikuláš Zalai.

- DEMO here means SOFTWARE PRODUCT installed on your computer, before you paid the ACTIVATION FEE. DEMO has limited functionality and you are not allowed to use its SOFTWARE OUTPUTs for commercial purposes.

- ACTIVATION FEE is amount of money which you pay to the AUTHOR in order to activate your DEMO installation. After paying the ACTIVATION FEE and activating your DEMO installation, you will obtain LICENCE to access full functionality of the SOFTWARE PRODUCT and to be allowed to use SOFTWARE OUTPUTs for commercial purposes.

- LICENCE here means a limited and non-exclusive licence to use the SOFTWARE PRODUCT and SOFTWARE OUTPUTs for commercial purposes under conditions stipulated in this "CrosswordJet" End User License Agreement (EULA).

TERMS OF USAGE:

Your installation and use of this copy of SOFTWARE PRODUCT indicates your acceptance of this LICENCE. If you do not agree to any of the terms of this LICENCE, then do not distribute, install or use the SOFTWARE PRODUCT.

This SOFTWARE PRODUCT may be installed and used by on only one computer. Its component parts may not be separated for use on more than one computer. This SOFTWARE PRODUCT is not supposed to be accessed through a network.

TERMS OF PAYMENT:

You can install the SOFTWARE PRODUCT on your computer for free and use it for trial period of 30 days. Right after the installation, your SOFTWARE PRODUCT is in DEMO mode. If you decide to buy the SOFTWARE PRODUCT to enable its full functionality and to obtain the LICENCE, you will be asked to pay the ACTIVATION FEE. After paying the ACTIVATION FEE you can activate your installation of the SOFTWARE PRODUCT on your computer (the computer is identified by the ComputerName system variable and other unique identificators).

After the activation of your SOFTWARE PRODUCT installation you are allowed to use its SOFTWARE OUTPUTs for commercial purposes.

COPYRIGHT AND DISCLAIMER:

The AUTHOR is the owner of the copyright of this SOFTWARE PRODUCT (except for the contents of the word/clue database which was compiled from publicly available resources). All of derivatives, title and accompanying components and materials of this SOFTWARE PRODUCT are the exclusive property of the AUTHOR. All rights of any kind, which are not expressly granted in this LICENCE, are entirely and exclusively reserved to and by the AUTHOR. You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this SOFTWARE PRODUCT. There are no third party beneficiaries of any promises, obligations or representations made by the AUTHOR herein.

You may not disclose to other persons the data or techniques relating to this SOFTWARE PRODUCT that you know or should know that it is a trade secret of the AUTHOR in any manner that will cause damage to the AUTHOR.

You may not allow third parties to use this SOFTWARE PRODUCT in any way for any purposes. This LICENCE shall not be transferred to any of your legal successors.

This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of SLOVAKIA.

This SOFTWARE PRODUCT is distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.

In addition, in no event shall the AUTHOR, or its principals, shareholders, officers, employees, relatives, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of SOFTWARE PRODUCT and/or its SOFTWARE OUTPUTs.

In addition, in no event does the AUTHOR authorize you to use this SOFTWARE PRODUCT in applications or systems where SOFTWARE PRODUCT's failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold the AUTHOR harmless from any claims or losses relating to such unauthorized use.

This SOFTWARE PRODUCT and all services provided may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any SLOVAK and/or EU law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold the AUTHOR harmless from any claims resulting from the use of this SOFTWARE PRODUCT, which may damage any other party.
